How Much Does a Real Estate Attorney Cost in Vermont?

If you are buying, selling, or refinancing a home in Vermont, one of the questions you may have is: How much does a real estate attorney cost?
Attorney fees vary depending on the type of transaction and the work involved. At Peet Law Group, we generally charge a predetermined flat fee for standard residential real estate transactions rather than billing clients by the hour. Our current attorney fees typically range from $1,600 to $1,850 for a residential purchase, $1,200 for a residential sale, and $1,300 to $1,500 for a residential refinance.
These are attorney fees for standard residential transactions. They are not the same as your total closing costs. Buyers, sellers, and borrowers may have other expenses payable to lenders, title insurance companies, government offices, municipalities, and other third parties.
Attorney Fees for Buying a Home in Vermont
Peet Law Group's attorney fee for a standard residential purchase generally ranges from $1,600 to $1,850. The amount within that range depends primarily on the complexity of the transaction and the lender's requirements.
The fee covers much more than simply having an attorney conduct the closing. Our representation generally begins with review of the purchase and sale contract and continues through the completion of the closing.
The purchase fee generally includes review of the purchase and sale contract, the title search, title examination, coordination with the lender and other parties, review and preparation of closing documents, answering client questions, resolving typical issues that arise during the transaction, and conducting the closing.
In other words, the fee is designed to cover the ordinary legal work required to represent a residential buyer from contract through closing.
Another important feature of our pricing is what happens if a purchase does not close. Peet Law Group typically does not charge a buyer for contract review when the transaction does not result in a closing. In most transactions that fall through, we generally do not charge for the legal work already performed and instead ask the client to return to us when another purchase comes together. An exception may apply when unusually complex issues have required substantial additional attorney time.
Attorney Fees for Selling a Home in Vermont
For a standard residential sale, Peet Law Group generally charges a $1,200 flat attorney fee.
The seller's attorney does considerably more than prepare a deed. Our standard residential seller representation generally includes preparation of the deed, Vermont Property Transfer Tax Return and other required conveyance documents, preparation of required seller disclosures, communications and coordination with the buyer's attorney, mortgage payoff coordination when applicable, answering the seller's questions, and resolving the typical legal and closing issues that arise during the transaction.
Additional attorney fees may apply in circumstances requiring work outside a standard residential sale. Examples can include preparation of a power of attorney, attorney attendance at the closing, significant title problems that must be resolved, complicated tax issues, or other unusual legal work.
Commercial real estate transactions are also priced separately. Contact Peet Law Group for pricing for a commercial purchase or sale.
Attorney Fees for Refinancing a Home in Vermont
For a standard residential mortgage refinance, Peet Law Group's attorney fee generally ranges from $1,300 to $1,500.
The refinance fee includes both the title search and the closing, as well as title examination, coordination with the lender, review and preparation of the necessary documents, and resolution of the typical issues that arise during the refinance process.
The primary factor affecting where a refinance falls within the $1,300 to $1,500 range is the lender's requirements.
Flat Fees Make Vermont Real Estate Attorney Costs More Predictable
One important consideration when comparing real estate attorney fees is whether the attorney charges a predetermined flat fee or bills by the hour.
Peet Law Group generally uses flat-fee pricing for standard residential real estate transactions. This allows clients to know their attorney fee in advance rather than wondering how many hours, telephone calls, emails, document reviews, or routine issues will ultimately appear on a legal bill.
Hourly legal fees can be difficult to predict because the final cost depends on how much attorney and staff time a transaction requires. Depending on the circumstances, hourly billing can result in a substantially higher legal bill than initially anticipated.
Our flat-fee approach is intended to provide competitive and predictable pricing while including the ordinary legal work required to bring a residential real estate transaction from contract to closing.

Attorney Fees Are Not the Same as Total Closing Costs
It is important to distinguish the attorney fee from the total closing costs associated with buying, selling, or refinancing Vermont real estate.
For example, title insurance is a separate charge and is not included in the attorney fee. The cost of title insurance depends on factors including the purchase price and loan amount.
Depending on the transaction, there can also be recording fees, taxes, lender charges, municipal charges, and other expenses payable to third parties. Wire fees and courier fees may also be added to Peet Law Group's legal fee when applicable.
As a result, a buyer should not assume that a $1,600 to $1,850 attorney fee means that the buyer's total closing costs will be $1,600 to $1,850. The attorney fee is only one component of the overall cost of completing a real estate transaction.
